Legacy Forest Data Exchange Agreement

 

1.       Membership

 

1.1.                Only the Steering Committee of the Legacy Forest , by a 2/3-majority vote, may admit new members to the Legacy Forest Data Exchange Group.

1.2.                Members are understood in this agreement to mean: principal investigators of a given project.

1.3.                All members are subject to the terms and conditions of the Legacy Forest Data Exchange Agreement.

1.4.                The Steering Committee will consider application for membership based on:

a)        A stated intention to use the Legacy Forest 's data exclusively for purposes of scientific research, educational activities, or management planning.  Any other use will require a 2/3-majority vote of approval by the Steering Committee.

b)        An ability to add new data to the Legacy Forest 's Data Warehouse.

1.5.                Only the Steering Committee of the Legacy Forest may terminate a membership.  This occurs when it is the opinion of at least 2/3 of the members of the Steering Committee that termination of a membership is in the best interest of the Legacy Forest Data Exchange Group.

 

2.        Rights and Obligations of Membership

 

2.1.               Rights

 

2.1.1.                    Members will have complete access to all data holdings of the Legacy Forest Data Warehouse that are not classed as "restricted".

 

2.2.              Obligations

 

2.2.1.                  Members may use and make copies of data received through the Legacy Forest Data Warehouse for non-commercial end-use only.

2.2.2.                  Members agree not to disseminate copies of the data.

2.2.3.                  Within 3 months of joining the Legacy Forest Data Exchange Group, and annually thereafter, a member agrees to enter all of his or her data into the Legacy Forest Data Warehouse according to the following criteria:

a) These data do not currently exist within the Legacy Forest Data Warehouse.

b) These data may reasonably be regarded as potentially useful to others who may conduct research within the Legacy Forest

c) These data are deemed accurate and are in a usable electronic format.

2.2.4.                  Members entering data into the Legacy Forest Data Warehouse agree that such data may be redistributed to other members of the Legacy Forest  Data Sharing Group.

2.2.5.                  A member agrees to provide corrections and or updates that he or she makes to data received from Legacy Forest Data Warehouse.

2.2.6.                  Members planning to undertake any destructive sampling within the Legacy Forest agree to consult the Legacy Forest Data Warehouse for any possible conflict with other researchers; and, should a possible conflict exist, members agree to consult with one another to avoid such conflict. 

 

3.       Assessment of Restricted Data

 

3.1.                Upon the request of a member, a particular data set may undergo an assessment by the Legacy Forest Steering Committee to determine whether it can be classed as "restricted".  This may result in a member receiving written permission, from at least 2/3 of the members of the Steering Committee, to restrict access to a particular data set for period of time.  The set or type of researchers to whom these data are restricted must be clearly defined and the restriction period will be decided upon by at least 2/3 of the members of the Steering Committee.

 

4.       Funding

 

4.1.                Members of the Legacy Forest Data Exchange Group are exempt from funding the storage and distribution of digital data through the Legacy Forest Data Warehouse

4.2.                There are no royalties or other fees payable for allowable use of data

4.3.                The Steering Committee may impose a "special usage charge", upon written notification to a member, when a member who impose an extraordinary workload on the resources of the Data Warehouse.

 

5.       Data Distribution and Maintenance

 

5.1.                Members agree that, unless otherwise specified, the Administrator of the Legacy Forest Data Warehouse shall administer the data warehouse.  The Legacy Forest Steering Committee selects the Administrator.

5.2.               The Administrator is the agent for the distribution of data to members and the sole agent authorized to publish updates on the contents of the Data Warehouse.

 

6.       Intellectual Property

 

6.1.               A member providing data shall retain all copyright pertaining to the data provided. 

 

7.       Liability

 

7.1.             The Legacy Forest Data Exchange Group makes no warranties with respect to its data.  Members agree that the data are made available on an "as is" basis.

7.2.             The member who accepts data shall indemnify and save harmless any member who provides data.

 

8.       Termination

 

8.1.                   A member wishing to maintain involvement in the Legacy Forest Data Exchange Group agrees to provide written notice of this to the Steering Committee once every year.

 

Within 30 days of the termination date, the member whose membership has been terminated shall delete and over-write all backups and stored information obtained from the Legacy Forest Data Exchange Group.
